Pilates Parties Waiver & Release

for participants over 18

Pilates on Palm LLC, DBA Foundry Collective SRQ • Pilates Parties & Classes

1) Assumption of Risk (Exercise, Surfaces, Weather)

I understand Pilates involves physical exertion and inherent risks, including, but not limited to, muscle strain, slips/trips on variable surfaces (e.g., grass, sand, decking), exposure to heat/sun/wind, and the use of mats/props. I voluntarily assume all such risks.

2) Health Statement

I am physically able to participate and will disclose relevant injuries, conditions, or pregnancy. I will stop if I feel pain, dizziness, or distress and will inform the instructor.

3) Release of Liability (Ordinary Negligence Only)

To the fullest extent permitted by Florida law, I release and discharge Pilates on Palm, DBA Foundry Collective SRQ, its owners, contractors, instructors, employees, agents, and venue partners from claims arising out of ordinary negligence in connection with my participation. This release does not apply to gross negligence, willful/wanton misconduct, or intentional acts.

4) Indemnification & Hold Harmless

I agree to indemnify, defend, and hold harmless Pilates on Palm LLC, DBA Foundry Collective SRQ and venue partners from claims, damages, or expenses (including reasonable attorneys’ fees) brought by me or third parties arising from my participation, except to the extent caused by gross negligence or intentional misconduct of the released parties.

5) Medical Care Consent

If injury or illness occurs, I consent to first aid and, if necessary, emergency medical care. I am responsible for all related costs.

6) Environment & Equipment

I will use mats/props as instructed and return items in good condition.

I understand outdoor classes may involve uneven terrain, sun/heat, wind, and other environmental factors; hydration, sunscreen, and appropriate footwear are my responsibility.

7) Photos/Video (choose one)

Please choose one option in the form below based on whether or not you consent to photo/video capture.

8) Alcohol/Refreshments

If the host provides alcohol, I confirm I am 21+ and consume responsibly. Pilates on Palm LLC, DBA Foundry Collective SRQ does not sell or serve alcohol.

9) Acknowledgment

I have read and understand this agreement for Pilates Parties. I am signing voluntarily.
